RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT - THIS IS A LEGALLY BINDING AGREEMENT AND BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO COMMENCE ANY LEGAL ACTION -PLEASE READ CAREFULLY!

It is my desire to participate in the paintball game (“PAINTBALL PARADISE game”) designed, hosted and operated by the business commonly known as “PAINTBALL PARADISE” (the “Business”). Accordingly, I the undersigned participant (the “Participant”) represent and warrant that: I am either 18 years of age and in good mental and physical health or, if I’m not the age of 18 or not in good mental or physical health, I will have my parent or guardian’s (“Parent” or “Guardian”, as applicable) sign this waiver where indicated below, to provide me with written permission to play or observe the PAINTBALL PARADISE game.

I/WE, the undersigned, HEREBY jointly and severally:

A. Represents and warrants that the undersigned Parent or Guardian has full legal responsibility for decisions regarding the Participant, or that the Participant is over 18 years of age on the date of signing this waiver and release.

B. Acknowledges and agrees that the PAINTBALL PARADISE game is a strenuous game, physically and mentally involving possible risk of injury of the Participant from equipment or other players and the playing environment.

C. Acknowledges and agrees that it is the intent of players in the PAINTBALL PARADISE game to assault the Participant during the game and that in order to do so, players will try to overcome any resistance that the Participant may exert by the use of force, including the use of an air gun, which is powered by CO2 or High Pressure cartridge which can exert a pressure of 800 pounds per square inch and a range possibly exceeding 200 feet, with pellets projected from such guns that measure approximately .68 inch in diameter and are made of biodegradable shell and dye.

D. Represents and warrants that the Participant and the Parent/Guardian has fully read and/or understood the safety instructions, rules and guidelines of the PAINTBALL PARADISE game as provided by the Business and, further, that the Participant agrees to play the PAINTBALL PARADISE game solely in accordance with such safety instructions, rules and guidelines and, further, comply with any and all instructions of employees and referees of the PAINTBALL PARADISE game.

E. Acknowledges and agrees that the responsibility for the personal safety and risk of injury of the Participant remains solely with the Participant and that the Business, including but not limited to its principals, directors, officers, shareholders, employees, agents, consultants and contractors, take no responsibility for ensuring the personal safety of, nor preventing injuries to, the Participant.

F. Acknowledges and agrees that: (i) the Business does not warrant the condition or safety of equipment, facilities or premises, natural or constructed, or the availability of a doctor or medical care, used by or in connection with the PAINTBALL PARADISE game; and (ii)the Business, including but not limited to its principals, directors, officers, shareholders, employees, agents, consultants and contractors,is not insured for any legal liability whatsoever that may arise by the Participant’s involvement and participation in the PAINTBALL PARADISE game.

G. Represents and warrants that: (i) the Participant will pay all such fees as required by the Business including such fees as required by the Business to participate in the PAINTBALL PARADISE game and that the Participant understands that there will be no refunds of such fees under any circumstances whatsoever; and (ii) the Participant is solely responsible for the return of, or the replacement value of, the following equipment at the following values upon the expiry or conclusion of the PAINTBALL PARADISE game, namely Planer Eclipse Emek guns ($300.00), Tippmann 98 Custom, FT12 @ A5 guns ($200.00), High Pressure Air Cylinder and Regulator ($150.00), Protective Helmet ($50.00) and Coveralls ($50.00).

H. Acknowledges and agrees that, by evidence of the signatures below, the Participant and Parent/Guardian hereby consents to the free use of the Participant’s photograph or other recorded image or sound reproduction in any future promotional materials or advertising of the Business, in such form and at such times as the Business may in its sole discretion determine, and the Participant and Parent/Guardian hereby waives any claim for compensation or reimbursement with respect thereto.

NOW THEREFORE inconsideration for permitting the undersigned Participant to participate in the PAINTBALL PARADISE game, and on behalf of my/our respective heirs, executors, administrators, successors and assigns, I/WE, the undersigned, HEREBY jointly and severally:

1. Absolutely and forever release, remise, acquit and dischargethe Business,and its directors, officers, shareholders, employees, agents, consultants, contractors, heirs, executors, administrators, successors and assigns (collectively the “Releasees”) of and from all manner of action or actions, cause or causes of action, suits, dues, sums of money, claims, losses, expenses, demands or damages, of any nature and kind whatsoever, both in law and equity, which weand/or our next-of-kin, or any of them, has had, now has or can, shall or may hereafter have, for or by reason of or in any way arising out of any cause, matter or thing whatsoever and in particular, without limiting the generality of the foregoing, for or by reason of or in any way arising out of any injury (including serious injury), disability, death, damage or loss (of any kind) that may be sustained by the undersignedParticipant and/or his/her next-of-kin, or any of them, regardless of howsoever sustained and/or howsoever caused (including, without limitation, negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under relevant occupiers liability laws), as a result of attending at and participating in the PAINTBALL PARADISE game. In relation to the foregoing release, I/we hereby accept an unqualified assumption of all risks associated with the participation of the Participant in the PAINTBALL PARADISE game.

2. Agree to not commence any legal action against the Releasees, or any of them, for any matters to which the foregoing release may relate. I/We hereby further agree not to make any claim or to take any proceedings on account of the said claim, injury, loss or damage against any persons, firm or corporation who may claim contribution or indemnity from the Releasees, or any of them, under the provisions of any statute or otherwise.

3. Agree to indemnify and to save and hold harmless the Releasees, and all of them, from any and all expenses whatsoever for any matters to which the foregoing release may relate including (without limitation) litigation expenses, legal costs, liabilities, damages, awards or costs, of any form or type whatsoever.
